Classic International Cruises Booking Conditions

MOBILITY/SPECIAL NEEDS:
CIC ships are not ideally suited to guests in wheelchairs or those with limited mobility, ask your agent to check with us at the time of booking. There are no wheelchair accessible cabins onboard. The layout of the ship could considerably restrict such passengers’ movement around the vessel and preclude access to some ports of call and all cabins on Athena have a bath with a shower over the top. Passengers with mobility limitations or who have special needs that are accepted for travel must be accompanied by at least one able-bodied companion who will be responsible for general care and assistance throughout the cruise.

PASSPORTS/VISAS:
Passports are required on all international cruises and must have at least six months validity from the end of the cruise. Guests not travelling on an Australian passport must have a re-entry visa for Australia. Travel on your cruise will not revalidate an Australian re-entry visa. It is the passenger/travel agent’s responsibility to obtain any necessary visas and to check with us to ascertain if any group visas are applicable to the ports of call visited on the cruise. Guests who do not have proper documentation may be refused boarding and will be subject to any fnes or costs incurred.

DOMESTIC CRUISES/CRUISES TO NO WHERE:
Guests travelling on Australian domestic and cruises to no where must take photograph identifcation. Due to government regulations the casino is not permitted to operate on these cruises. Onboard prices are subject to GST and duty free purchases are not permitted on domestic cruises.

SMOKING:
In the interest of our guest’s health, safety and enjoyment during their cruise holiday, smoking is not permitted indoors onboard Athena. This includes passenger cabins, dining rooms and all food service areas onboard our ships. Outdoor smoking venues will be published in the daily newsletter.

TRAVEL INSURANCE:
At the time of deposit, it is essential and highly recommended that you take out comprehensive international travel insurance to cover any eventuality, including any pre-existing medical conditions and charges should you have to cancel your holiday plans.


TERMS AND CONDITIONS:
1. When we receive the signed Booking Form and the applicable deposit, a contract will come into existence in relation to your cruise on the terms and conditions set out in this document.  In these terms and conditions “Classic International Cruises”, “we” and their grammatical variants mean Classic International Cruises Pty Limited. “You”, the “passenger” and their grammatical vari-ants mean each of the intending passengers named on the Booking Form. The person who signs the Booking Form warrants that he or she has authority from each of the intending passengers to enter this contract on their behalf. Where a passenger is a minor (being a person under the age of 18), the person signing the Booking Form agrees to indemnify Classic International Cruises from any loss or damage arising by reason of a claim made by or on behalf of that minor against Classic International Cruises or any third party.


2. We reserve the right, if we think it necessary, to deviate from the ship’s advertised route, to delay or cancel part of, or the whole cruise, to substitute or change the ship or ports of call, to remove the ship from service, charter out the ship, or to tow or assist any vessel or perform any similar act, in our absolute discretion or that of the Captain. In such an event Classic International Cruises shall not be required to refund any portion of the fare, make any other compensation or be liable for any other consequential damage, loss, expenses, loss of time or inconvenience. Accordingly, you should not make any important arrangements or meetings based on the proposed itinerary of the cruise, which may change without liability to Classic International Cruises.

3. Cancellations, for whatever reason, will be subject to the following charges:
more than 120 days prior to sailing, $75 per person;
between 119 – 90 days prior to sailing, 50% of deposit;
between 89 – 60 days prior to sailing forfeiture of deposit regardless of fare paid;
between 59 – 30 days prior to departure 50% of total fare;
less than 30 days prior to departure or non appearance at the time of sailing, 100% of total fare.
There will be no refund for any reason for guests who disembark during their cruise. Deposits and payments for a cruise are not transferable. Additional handling/service fees may be imposed by your travel agent.

4. We are not required to refund any portion of your fare nor pay any expenses whatsoever including any transportation, medical or living expenses if you leave the cruise early, and any such expense which is reasonably incurred by us on your behalf shall be payable by you to us on demand.

5. We have the right to charge the fare applicable at the date of departure. Any difference must be paid before you board the ship or commence the cruise.

6. Amendments to your booking are permitted after your deposit has been received and will incur an AUD$50 amendment fee per passenger.

7. It may be necessary for security reasons for us or people working for us or port/government agencies to search you and/or your luggage and goods. You agree to allow such searches.

8. (i) The Captain, at all times, has the right to confne, have sedated or to put ashore any passenger whose conduct inconveniences or jeopardises the enjoyment, health or safety of any passenger or other persons. Classic International Cruises shall not be liable for such actions or for any loss incurred (including repatriation expenses) and refunds are not payable. Any expense incurred by us under this clause shall be payable by you to us on demand.
(ii) You consent to Classic International Cruises receiving any medical information and documentation resulting from you consulting the onboard Medical Department, and to Classic International Cruises disclosing these internally as well as to external advisors and insurers.
(iii) At the time of paying your deposit, it is strongly recommended that you obtain valid compre-
hensive international travel insurance covering you for the duration of the cruise. You agree to
provide proof of this insurance to Classic International Cruises if requested. You should carry a
copy of the policy with you on your cruise holiday.

9. You must tell us in writing at the time of booking (a) about any recent or current physical or mental condition that may require medical or special treatment (including travelling in a wheel-chair); and (b) if you intend travelling with any medical apparatus, so we can ensure the apparatus will operate onboard and we can send you an information sheet. If we think that your state of physical or mental health means you are unft for travel, or that you may be a danger to yourself or other passengers, we may refuse your booking, even if you have paid the full fare or a deposit. If you have a known medical condition, you must show us a certifcate of ftness before you board, clearly stating your name, the ship, departure date and cabin number. You must also bring a recent medical history from your doctor and a list of current medications. You must bring suffcient quantities of any prescribed medication to last the duration of the cruise.

10. Subject always to our right to limit liability under applicable law or Convention:
a. Subject to clause 10(d) we are not liable for the death, injury or sickness of any passenger however arising, whether or not arising in the course of performance of the cruise, and whether or not caused by our negligence or by the negligence of our servants or agents.
b. Subject to clause 10(d) we are not liable for the loss of or damage to any luggage or goods,
including valuables, however arising, unless caused by our proven negligence, in which case our
liability is limited to AUD$1,500.
c. If, notwithstanding the exclusions of liability in (a) and (b) above, Classic International Cruises is found liable to pay compensation for death, personal injury, sickness of any passenger, or for the loss of or damage to any luggage or goods, then such liability will be reduced in proportion to any contributory negligence by you.
d. Where the Trade Practices Act 1974 applies and it is not possible to exclude, restrict or modify any conditions, warranties or other rights implied into this contract, Classic International Cruises’ liability for any breach of condition, warranty or other right is limited to supplying the relevant cruise again or the cash equivalent.

11. Luggage shall be deemed to have been delivered undamaged to you unless written notice of any loss or damage is given to us within seven days from the date you leave the ship.

12. Except where it operates as a carrier, Classic International Cruises acts only as an agent for airlines, bus companies, hotels, shore tour operators and boat or dive operators. Accordingly, we shall not be liable in connection with any of these principals’ services. Nor shall we be responsible for information supplied concerning any of those principals’ services. Our responsibility does not extend beyond the ship. Whenever you leave the ship, any arrangements made by or for you are at your own risk.

13. Any action, claim, suit or proceeding arising out of or connected in any way with this contract or the cruise shall only be brought in New South Wales and shall be governed by New South Wales law as shall this contract. Subject to clause 10 any claim must be notifed in writing to Classic International Cruises within 28 days of you leaving the ship or the date you frst had knowledge of the material facts giving rise to your claim, whichever frst occurs. Any action, claim, suit or proceeding must be commenced within one year of you leaving the ship or of the date when you frst had knowledge of the material facts giving rise to your claim, whichever frst occurs. If either of these conditions is not complied with, any action, claim, suit or proceeding and all rights whatsoever and howsoever shall be absolutely barred and extinguished.

14. You agree that in entering into this contract Classic International Cruises is acting as agent or trustee on behalf of the ship, its owners, its operators, the Captain, crew, any staff or agents of Classic International Cruises, any charterer of the ship and any substitute ship, its owners, its operators, its Captain and crew and that all such entities and persons shall have the beneft of all rights of exemption contained in these Passage Conditions. You undertake not to make any claim against any person or entity other than Classic International Cruises and if such claim should nevertheless be made, you agree to indemnify Classic International Cruises and the person or entity against whom such claim is made against the consequences thereof.

PRIVACY POLICY
Upon completion of your cruise, your booking information is automatically transferred to our
past passenger database to ensure that you are notifed of special offers that are regularly made
available to our past passengers. If you do not wish to receive such offers, please contact us. We respect your privacy and the personal information you provide to us with your booking form may be required to be disclosed to certain organisations (e.g. customs and immigration authorities or airline carriers) but only as necessary. We will not be able to properly facilitate the booking, carriage and administration of your cruise if you do not provide us with the information requested on the booking form.
